Eligibility

The Promotion is open to legal residents of the United States, including the District of Columbia, who: (a) are eighteen (18) years of age or older (or the applicable age of majority, if greater than eighteen (18) years of age in their respective jurisdictions); and (b) can enter into legally binding contracts under applicable law.

Agreement to Rules

By participating, the Contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of IM Pro Makeup NY LP, a limited partnership incorporated under the laws of the state of New York, from 110 Greene St., New York NY 10012 (“IL MAKIAGE”).

How to Enter

(a) Email Entry. In order to enter the Promotion during the Promotion Period via email, you must: (i) receive the initial invitation link by email (“The Advocate”); (ii) The Advocate must share the referral link; up to 5 persons (“The Friend); (iii) The Friend must enter all required information in the directed Typeform survey, completing the entire form.

How to Win a Prize

(a)   The Advocate. In order to win a $15 e-gift, The Advocate must have at least one (1) Friend complete the typeform.

(b)   The Friend. In order to win a $15 e-gift, The Friend must complete the Typeform survey.

Rules

(a)   The Advocate can earn up to one (1) e-gift valued at $15. The Advocate does not win additional e-gifts if more than one (1) Friend completes the Typeform survey.

(b)  The Friend can earn up to one (1) e-gift valued at $15. The Friend does not win additional e-gifts if they complete the survey more than one (1) Typeform survey.

The rewards are non-cumulative so Winners can only receive up to $15 total in e-gifts. The rewards will be distributed by providing each Winner with a discount code via email up to 48 hours after winning.  The discount code can be used on the IL MAKIAGE website and will allow the Winners to order their prizes. The specifics of the reward shall be solely determined by IL MAKIAGE. No cash or other reward substitution shall be permitted except at IL MAKIAGE’s discretion. The prize is non transferable. Any and all reward-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. Acceptance of rewards constitutes permission for IL MAKIAGE to use Winner’s name, likeness, statements about the Campaign, and biographical information for purposes of advertising and trade without further compensation, unless prohibited by law.

IL MAKIAGE shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the reward within 90 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release if required, the reward may be forfeited. Receipt by Winner of the reward offered in this Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations. Any violation of these official rules by Winner (at IL MAKIAGE’s sole discretion) will result in winner’s disqualification as winner of the Campaign, and all privileges as Winner will be immediately terminated.

Rights Granted by You

By entering this content, You understand and agree that IL MAKIAGE, anyone acting on behalf of IL MAKIAGE, and IL MAKIAGE licensees, successors, and assigns, shall have the irrevocable, non-exclusive, fully sublicensable license and right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your name, email address, likeness, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purpose without any further compensation, notice, review, or consent.  In addition, by entering this content, You consent to use of your personal information (including your name and email address) by IL MAKIAGE and its authorized agents for the purposes of email marketing and/or any other promotional or advertising purpose in any channel now known or hereafter developed.

Other Terms & Conditions

IL MAKIAGE reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Campaign for any reason. In such case, IL MAKIAGE will reward Winners based on all eligible entries received prior to the action taken by IL MAKIAGE. IL MAKIAGE reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or website or violates these Terms & Conditions. IL MAKIAGE has the right, in its sole discretion, to maintain the integrity of the Campaign, to void votes for any reason, including, but not limited to: multiple entries from the same individual; entries from ghost email addresses; or the use of bots, macros, scripts, or other technical means for entering. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, IL MAKIAGE AND/OR VIRAL LOOPS WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Limitation of Liability

By entering, You agree to release and hold harmless IL MAKIAGE and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries; (vi) any incorrect or inaccurate information entered, whether caused by You, by IL MAKIAGE or by  any third party; (vii) tampering, hacking or by any equipment or programming associated with or utilized in the Campaign.

In the event of cancellation or termination (including partial, temporary or other cancellation or termination), IL MAKIAGE reserves the right to select the winners for each applicable entry from among all eligible entries received prior to date of cancellation or termination using any judging criteria it deems fit.
